USER CONDUCT

You understand that all information, data, text, photographs, graphics, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not AMC Bridge, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Software. AMC Bridge does not control the Content posted via the Software and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will AMC Bridge be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Software. You agree to not use the Software to upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable, harm minors in any way, impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Software, as well as any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements), also any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party, or contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

INDEMNITY

You agree to defend, indemnify and hold AMC Bridge, its affiliates, officers and employees, harmless from and against any claim, action or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any Content you submit, post to or transmit through the Software, your violation of these TOS, or your violation of any rights of another.

USE OF CONTENT POSTED BY USERS

You acknowledge that AMC Bridge may or may not pre-screen Content, but that AMC Bridge and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any Content that is available via the Software. Without limiting the foregoing, AMC Bridge and its designees shall have the right to remove any Content that violates the TOU or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by AMC Bridge or submitted via the Software.

TERMINATION

AMC Bridge reserves the right to discontinue access to Software to any person that does not comply with these TOU, as solely determined by AMC Bridge. Termination of your right to access or use the Software is in addition to all other legal or equitable remedies available to AMC Bridge.

APPLICABLE LAWS

AMC Bridge makes no representation that materials at this website are appropriate or available for use outside of the United States and access to them from territories where their contents are illegal is prohibited. Those who access this site from other jurisdictions do so on their own initiative and are responsible for compliance with applicable local laws. Any claim relating to the materials on this website shall be governed by the substantive laws of New Jersey, excluding its principals as to conflicts of law or the United Nations Convention on contracts for the International Sale of Goods. You acknowledge, consent and agree that AMC Bridge may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce the TOU; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of AMC Bridge, its users and the public.

AMC Bridge was formed by a team of experienced industry professionals who focus on computer-aided design, engineering, and manufacturing.

This Policy is adopted by AMC Bridge, Inc., its subsidiaries, and affiliated companies.

AMC Bridge consists of the following entities: AMC Bridge, Inc. (USA), AMC Bridge Software LLC (Uzbekistan), AMC Bridge Technology India Private Limited, and POAM Software SP. Z O.O. (Poland).

This Privacy Policy Notice outlines the way AMC Bridge ("Company," "we," "us," or "our") collects, uses, maintains, protects, and discloses information collected from users ("User", “you,” “your”) of this website and other resources used in our commutation.

Our website is not designed or directed at children. In accordance with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), we will not intentionally collect, maintain, or distribute information about anyone under the age of 13. We may collect, process, and keep the following kinds of personal data:

  • • Information you provide when you apply for one of our published vacancies or if you choose to fill in a separate registration form (we receive your CV, name, and contact information).
  • • Information you provide if you wish to subscribe to our email notifications and invitations to our online events (including your name and email address).
  • • Information contained in or relating to any communication that you send to us or send through our website, share with us job boards or social media (including correspondence with us, some part of communication content, as well as all the associated metadata).
  • • Information you place in our registration forms if you wish to participate in our online events – conferences and webinars (including your name and email address).
  • • Consent for text message communications: By submitting your phone number, you agree to receive text messages from AMC Bridge.
  • • All types of feedback we give and receive from you (including all interview feedback).
  • • Other personal information you choose to provide (emergency contacts, referrals, documents).
2. Personal information we get from third parties

We may also receive personal information about individuals from third parties. Such cases include receiving a CV you have published on a job board, getting a link to your profile in LinkedIn, or a recommendation of you as a potential candidate on a vacancy provided by another person or organization.

3. Consequences of not providing your personal data or consent withdrawal

You are not obliged to provide your Personal Data to us. However, as this information is required for us to provide you with our services or respond to your inquiries, we will not be able to offer some or any of our services without it.

You may withdraw your consent at any time with effect in the future.

The full amount of provided personal data will be kept as long as necessary for our cooperation or until the consent is revoked. When it happens, we will store only minimum data about you (full name, contact details, your CV, our references, and notes) to the extent justified by legitimate interest.

In case you wish to provide the least amount of information while visiting our website or sending a request using the correspondent form, it is possible to limit such information to the required fields (i.e., your name and email address.

Please note, that if you do not share any of your data with us, we will not be able to reach you to provide information or assistance on most questions you have for us. Moreover, if you decide to keep a very limited amount of personal data available for us on a long term, it may affect further communication steps (e.g., if you decide to apply for a job and join our team).

4. How long we keep your data

We only retain Personal Data for as long as is necessary. In retaining Personal Data, we consider:

  • • We may process your full name, contact details and your CV (which contains social media profiles, date of birth, education records, employment history, notice period at current employer, degrees, professional skills, interests, knowledge of foreign languages, salary expectations, relocation interests, family status, citizenship, certifications) when you apply for our vacancy;
  • • The professional information you make public (e.g., you page on LinkedIn), when you communicate with us there;

Why we gather the information:

  • • To conduct PR and marketing research;
  • • To analyze our website visitors for improving the service;
  • • To plan the next activities and prepare analytics;
  • • To personalize communication with you and target our advertisement;
  • • To ensure the effective the effectiveness of the recruitment process for all parties involved;

If you are no longer interested in the materials, you are free to inform us and cancel your subscription. In case you do not provide enough information for your successful recruitment, we may ask you to extend it.

5.2. Based on AMC Bridge legitimate interest:

When we gather your personal data:

  • • We may process your full name, contact details, links to social media, position, employer, professional experience, gender, comments you left, photos and videos (to the extent permitted by law) when you participate or have plans to participate in our events;
  • • We may also process this information when you contact us using our website or any external resources;
  • • Some of your other personal data (e.g., feedback after the first interview) may be handed to other parties to make our communication precise (e.g., to share information on your performance during an interview with a customer);
  • • We may gather and use your photos and video footage from our events (to the extent permitted by the law);

  • • To respond you and organize our communication (letters, phone calls, online or live meetings);
  • • To inform you about the future activities you may find interesting;
  • • To promote our company in ads;

When you give your consent, you enable us to record and store this information using specialized tools and CRM (Customer Relationship Management) systems.

6. Your rights relating to your personal data

Under this Notice, you have the following rights:

  • Right to Access. This right enables you to request confirmation of whether we process personal data relating to you, and if so, to request a copy of that personal data. If such access cannot be granted in a decent period, AMC Bridge will set a deadline upon which the data will be provided.

7. Disclosing and transferring personal data

We do not sell, trade, or rent Users' personal information to third parties without the User's consent and only in the cases specified above. We may share anonymized, aggregated User information with our business partners, trusted affiliates, and advertisers for the purposes noted above. We may use third-party service providers to help us operate our business, manage the site, or administer activities on our behalf, such as distributing newsletters or surveys. We notify Users about transferring personal data to third parties in registration forms or other promotional materials.

We may disclose your personal information to any or all our subsidiaries and affiliates.

Some parts of your personal data like your CV or interview feedbacks can be handed to other parties (technical interviewers, PMs, directors) only if it is required by the process.

8. Business relations, based on AMC Bridge legitimate interest

If you represent our current or potential client, vendor, business partner or investor, the following personal data may be processed: your full name, contact information, current and previous positions in corresponding companies, activities related to sales, all our recorded communication with you with feedback and reports on such communication, data on your current position and publicly available personal information. We need it to maintain proper business communication with AMC Bridge, engage a new business with the company you represent and share updates, organize the approval, processing and signing of contracts, acts and invoices, provide confirmation on the quality of our service.

9. Additional notes for our applicants

In case you intend to give us personal information of a third party (e.g., your teacher/team leader/supervisor who shared a reference about your performance) you are obligated to ensure that person knows about it.

Before you provide us with a recommendation of another person, you must obtain that person's consent and give us documented evidence. This information will be checked by us. To do so, you should share the email of the referred person, so we could share this message:

Please give your consent to the transfer of your personal data such as: your full name, contact details, location, publicly available professional information, reference, education records, certifications, salary expectations and your CV to be recommended as a candidate for one of the vacancies published by AMC Bridge, Inc.

The data controller of the filing system, in which your personal data is stored and processed will be AMC Bridge, Inc.

If you have questions, you may contact the Data Protection Officer by this email – dpo@amcbridge.com. The data controller will treat your personal data as confidential and will only process such information in compliance with GDPR regulations. The team members in HR and internal departments of AMC Bridge in the countries of presence have access to the systems where your data will be safely kept, but they will process your personal data only for the purposes of organizing and maintaining the recruitment and further employment processes.

Your personal data will be kept until the consent is revoked, unless otherwise prescribed by applicable legal requirements or if it is necessary for further processing.

You have the right to control the amount of provided personal data and you can ask to make corrections/updates to it. You may also restrict and object to data processing as soon as you find it necessary. If you do not wish us to use the information which has been provided to us any longer, please inform the DPO with a correspondent notification.

10. Retaining personal data

Your personal data is stored by AMC Bridge on its servers, and on the servers of the cloud-based database management services as well as CRM systems and other tools.

Personal data that we are processing based on your consent will be kept until the consent is revoked, unless it is necessary for legal reasons described in the previous chapters.

When our communication ends, we may keep some part of your personal data (full name, a CV, references, contact information and feedback on your performance) until the consent is revoked.

11. Security of personal data

To help protect the privacy of data and personally identifiable information you share with us, we provide physical, technical, and administrative safeguards.

We update, test, and strengthen our security measures on a regular basis. Access to your personal data is limited to those employees who are responsible for communication and provision of benefits and services for you. Our team members are regularly educated and consulted on our cyber security and data privacy rules and their further updates.

In case of any issues, we will notify you and put all our efforts into eliminating all possible risks to your personal data, even if it takes place because of the third party (services used for processing).

12. Communication preferences

You have the option to manage your communication preferences with AMC Bridge. You may opt out of receiving communications, including marketing emails and other text messages, at any time. To unsubscribe, reply to any message with STOP or follow the opt-out or unsubscribe instructions at the bottom of the email. Alternatively, you can contact us at dpo@amcbridge.com. This will discontinue communications from the specified phone number or email address. Please note that you may still receive other service-related and non-marketing text messages from other channels managed by the Company, and you can opt out of them in a similar fashion.

AMC Bridge may update this Policy at any time and without any more notice. By using the Site and our online resources, data subjects acknowledge and agree that it is their responsibility to review this Notice periodically.
